A person is not guilty of aiding and abetting a breach of an intervention order if the person is a person protected by the intervention order that has been contravened and the conduct constituting the contravention did not contravene in respect of another person protected by the order or by any other intervention order where that person ought to have been aware.
There is no mechanism in which a protected person can be charged for affecting a breach of the order of a defendant. However, if this creates a situation where the protected person has aid and abetted a breach of bail – due to specific terms named within – then they may be charged.
