What Are The Penalties For Drug Trafficking?

Most drug offences generally fall under 2 main classifications

Controlled Substances

A controlled substance is generally a drug or chemical whose manufacture, possession, or use is regulated by the government. This includes, but is not limited to, ecstasy, cocaine, methamphetamines and heroin. If you are caught in possession with more than 2 grams of a controlled drug, it is presumed that you are going to sell it.

Cannabis

Cannabis offences relate to the growing, manufacturing and cultivation of the plant itself, and the selling and distribution of the plant, leaf, bud or plant material. If you are in possession of 250 grams of cannabis, you are presumed to be trafficking that amount. Likewise, if you are in possession of over 1 kilogram, you are presumed to be trafficking a commercial quantity, while over 2 kilograms is a large commercial quantity.

The penalty structure will depend on the quantity of the drug (based on weight) and the intention of the person possessing it.

The maximum penalties for trafficking a controlled drug or cannabis are:

  • Large Commercial quantity (usually measured in kilograms): $500,000 or life imprisonment or both
  • Commercial quantity (usually measured in grams): $200,000 or 25 years’ imprisonment or both
  • Less than commercial quantity: $50,000 or 10 years’ imprisonment or both

Possible Defences For Drug Trafficking Offences

It may be a defence to the charge that:

  • It was not in your possession
  • It was in your possession for personal use
  • You did not intend to sell the drug
  • It was not a trafficable quantity
  • You were under duress
  • There was only one element of transaction
  • You suffer from a mental impairment

What The Prosecution Must Prove

The prosecution must prove that you:

  • Sold the drug; or
  • Had possession of the drug with the intention to sell; or
  • Took part in the process of sale.

There are two elements to prove possession:

  • Being in physical control of the drug, and
  • Knowledge (or intention) of having the drug.
