Circumstances
Our client was apprehended at Red Square Nightclub. He was observed attempting to sell drugs to various groups of people. After speaking to police he was located with 33 pink tablets which later turned out to be 3-4 Methylenedioxyanphetamine together money and a mobile phone. He was arrested and taken to the Watch House and charged with trafficking in a prescribed area.
He sought our advice and it was decided because of the nature of it that he should plead guilty upon his first appearance so that he could maximise his 40% discount for his sentence. We did that in the Magistrates Court.
The matter thereafter was adjourned several times until it came on for hearing in the District Court. In the interim we obtained a psychological report together with a large number of character references. We thereafter made sentencing submissions in the District Court and he was sentenced to 1 year 9 months 2 weeks and 4 days. Because of the amount of rehabilitation he had undertaken namely drug counselling, psychological assessment a non-parole period of 10 months was set.
Sentence was suspended upon him entering into a good behaviour bond. He and his family were very grateful for what has happened.
