Two counts of persistent exploitation of a child.

Circumstances

Our client was a middle aged man charged with persistent sexual exploitation of two children.

Jason Evitts, who represented our client in the District Court, successfully negotiated a plea resolution whereby the client pleaded guilty to a number of charges of unlawful sexual intercourse.

Medical evidence was produced to the Court supporting the charged person’s medical history which enlivened the Court’s discretion to impose a sentence of imprisonment that was merciful notwithstanding the serious nature of the allegations and facts which formed the basis of the guilty plea to the charges.

The client acknowledged wrongdoing to serious offences but on a basis that was more favourable to the client than was originally alleged.

Charges of persistent sexual exploitation and unlawful sexual intercourse are very serious allegations which carry lengthy prison sentences if guilt is established.

The negotiated plea that Jason Evitts was able to achieve meant that the client was sentenced to a term of imprisonment much less than could otherwise have been expected. Although sentenced to imprisonment our client was under the difficult circumstances nonetheless satisfied with the result.
