Rape, Indecent Assault and Assault

Our client was alleged to have raped and indecently assaulted a friend of his after they had been out socialising. Both our client and the victim were 16 years of age. It was alleged that after going for a drive in the front seat of the vehicle the parties were parked and our client is allegedly to have forced himself upon the alleged victim. He was arrested and granted bail given it was a youth matter.

Our client was ultimately committed to stand Trial in the Adelaide Youth Court after a number of pre-trial hearings. During negotiations between Prosecution and defence Counsel a number of assertions were made as to the circumstances of the offending which in particular noted that any sexual contact between the parties was consensual.

Mr James Caldicott represented the client at the Adelaide Youth Court.

It appeared at first impression the case was very strong against our client however due to a number of inconsistencies and no corroborative evidence led by Prosecution it appeared the case was not as strong as first thought.

Due to proper and thorough analysis of case by Counsel and our office the witnesses were extensively cross-examined and our client came up to proof. The Judge hearing the matter handed down a not guilty verdict on all charges.
